Recently, Florida changed its laws with respect to sealing and expunging records. Now, if you have a conviction of any kind or have even sealed or expunged a record outside of the State of Florida, it will not affect your eligibility to sealing or expunging a record in Florida.
The Florida Department of Law Enforcement (FDLE) will not look at any criminal history outside of the State of Florida. When you submit your application to seal or expunge a Florida record, FDLE will only look at your Florida criminal history.
If you have a conviction of any kind within the State of Florida, you have an open case within the State of Florida, or you have previously sealed or expunged a record within the State of Florida, you will NOT be eligible to seal or expunge any Florida criminal record.
So if you have put off sealing or expunging a Florida criminal record because you have a conviction from another state, you may begin the process of sealing or expunging your Florida record immediately!
