The Florida Department of Law Enforcement is still processing sealing and expungement applications submitted in June of 2017. This is a major delay that is causing the sealing/expungement process to take upwards of 12 months in total.
The sealing process does not require the involvement of the State Attorney's Office, so that process takes a little less time than expunging a record. Expunging a record requires that the State Attorney in the judicial circuit in which the arrest occurred sign the application. This step in the process can take several weeks to several months.
Delays are common with FDLE and it normally depends upon volume of applications and number of processors.
If you would like to seal or expunge your Florida criminal record, you should begin the process as soon as possible to avoid future delays.
