The Miami man is accused of using Craigslist to advertise that he had marijuana to sell. The undercover deputy responded to the ad and a price of $320 for one ounce was agreed upon.
The Miami man drove down to the Keys to meet the buyer, who turned out to be an undercover deputy.
The Miami man was arrested once the cash for marijuana exchange was made. A search of his car revealed drug paraphernalia and one pill of Adderall. The Miami man did not provide a prescription for the Adderall.
The Miami man was charged with possession of marijuana with intent to sell, possession of a controlled substance, and possession of drug paraphernalia.
It is not considered trafficking in marijuana to be in possession of one ounce. You can be in possession of up to 25 pounds before the crime elevates from possession with intent to sell to trafficking.
