In the statutory classification of trafficking in MDMA (Ecstasy) trafficking over 400 grams is a first-degree felony punishable by 30 years. While the maximum sentence for all trafficking offenses - regardless of the amount - is 30 years, the mandatory minimum sentence changes depending on the amount of the substance.
Over trafficking in MDMA over 400 grams is the highest level of ecstasy trafficking. This offense carries a 15-year mandatory minimum prison sentence.
A mandatory minimum sentence is set by the legislature. Only the prosecutor has the legal ability to waive a mandatory minimum sentence. The court, cannot, under any circumstances, sentence a person charged with trafficking to a term of prison below the mandatory minimum unless the state agrees to waive the mandatory minimum.
There is also a $250,000 fine that is mandatory and can only be waived by the prosecutor.
