A Boca Raton man who has been serving a 12-year sentence in Florida state prison for DUI Manslaughter is now seeking early release from prison.
While the appeal is pending, the man's attorney has asked to court to issue a bond. Where appellate issues may be present after a criminal conviction, a court has the discretion to grant the accused a bond while the appeal is pending.
DUI Manslaughter carries a 4-year mandatory minimum prison sentence. Even if the sentence is reduced, the accused may still have to serve at least 4 years.
The accused allegedly backed his car into a pedestrian with a blood-alcohol level of .245. The legal limit in Florida is .08.
