In Florida, trafficking only 10 or more grams of MDMA is a first degree felony, punishable by a mandatory minimum of 3 years in prison and a $50,000 fine. The charge of trafficking more than 400 grams of ecstasy is a first degree felony. If the client were convicted of this charge, it would lead not only to a 15-year minimum sentence in prison, but to a $250,000 fine.
As soon as Attorney Matheny was on the case, he successfully persuaded the judge to reduce the bond, enabling the client to leave jail. When it came time for the arraignment, the prosecution filed the substantially reduced charges of possession of more than 10 grams of MDMA with intent to sell, and another count of possession of a controlled substance with intent to sell. If convicted, the client could have still faced 38 months to 35 years in prison.
It took months, but Attorney Matheny negotiated a plea of probation. This means that the client, who faced fifteen years to six whole decades in prison as a convicted felon, was not even sentenced to a day in jail.
