In another instance one of his clients, who had a prior arrest record consisting of a felony and various domestic violence offenses, was found with 50 pounds of marijuana growing in his home. The client was charged with marijuana trafficking and faced 45 years in state prison, with a mandatory 3-year minimum sentence, a mandatory $25,000 fine and the mandatory suspension of his driver's license. The prosecutor for the case made clear that he was unwilling to waive the mandatory 3-year minimum sentence. Thankfully, during the discovery process, Attorney Matheny was able to uncover the fact that police has previously trespassed on the client's property, thus violating his 4th Amendment rights. When confronted about the incident, one of the involved officers lied about it, despite the incident being recorded on the client's home security system. In the end, the trafficking charge was dismissed and the client was convicted on one count of owning property for the purposing of trafficking. He received no prison time, did not have to pay any fines, was sentenced to one year of probation. He was also able to keep his driver's license.
