As you may already know, Florida has mandatory prison time for drug trafficking offenses. What you should also know - and this may be obvious - is that the harshest mandatory prison sentences are reserved for the largest quantities of drugs.
With respect to trafficking in oxycodone (OxyContin), 28 grams or more of this substance will result in a mandatory 25-year prison sentence.
Trafficking in cocaine in excess of 400 grams will result in a mandatory 15-year prison sentence.
Trafficking in cannabis (marijuana) in excess of 10,000 pounds will result in a mandatory 15-year prison sentence.
Trafficking in MDMA (ecstasy) in excess of 400 grams will result in a mandatory 15-year prison sentence.
There are also high fines associated with each sentence as well.
Florida does not mess around when it comes to drug trafficking. The prosecutor is the only person in the criminal justice system with the power to waive a mandatory minimum sentence. The judge is literally powerless.
And remember, trafficking in Florida is based on weight, not the accused's intent. Simply possessing the required weight of any substance will be enough for you to be charged with trafficking. You do not need to be engaged in selling drugs to be charged with drug trafficking.
