Florida Statute section 322.212 makes it illegal to be in possession of a fake driver's license. In fact, it is a felony. This law particularly effects underage people.
It is illegal for a person to knowingly possess or display a forged, fictitious, stolen, or counterfeit driver's license or identification card.
It is a third-degree felony punishable by up to 5 years in state prison for being in possession of a fake ID as described above.
Many young people visiting from out of town find themselves arrested after trying to get into a bar or club by using a fake driver's license or ID card.
Penalties can range from Pretrial Intervention up to prison, depending on the accused's prior record.
