The 51-year old alleged victim suffered several injuries, including several broken teeth, a large cut on one of his legs and cuts on his hands.
Leaving the scene of an accident (LSA) is normally a misdemeanor, unless the alleged victim suffers serious bodily injury. In that case, LSA can become a third-degree felony.
If the alleged victim is in critical condition, then it likely means that he has suffered a serious injury. The driver whom police are looking for will likely face the felony charge.
Police will be looking for a van with front-end damage consistent with what is alleged to have occurred during the accident. If the driver makes a statement or confession, the police will have more than enough probable cause to arrest. That is why it is so important not to say anything to police without first speaking to a criminal defense attorney.
